can i still make a claim ???

hi there just wanted to know if would be able to make a claim, i fell down some steps in a well know brand of pub .
they were outside steps that have been covered in natral slate and it was raining it happend over 3 years ago.
i went to my doctors 2 days after and was told i had brused a muscal in my back .went to physio had about 5 sessions
and the pain was still there got no better it  was hurtting . went back two the doctors and told them that i wanted a mri because
the pain was doing my head in. i had told the doctors on the first ocssion that i knew what a buresed muscal felt like . 18 months on i have been to the pain clinic and had 3 epidurals and a host of pain killers and nerve drugs to stop my back from spazuming.i am 31 years old with 3 kids to look after and a morgage to pay and are now classed as disabled car'nt walke to far.
i was self empolyed builder always working and not doing to bad for my self NOW i can hardly walke cant play with my kids and waiting for an op which they might not do because i have two crushed vertabray and trap nerves in my back and its close to my spinal cord.I have been takeing tramadol for 18 months now to deal with pain had 3 mri scans.

I am sorry to hear about your situation.

The problem you have is that you state that the injury occured over three years ago.

In the UK we have what is called Statute of Limitation.  What this means is that you have three years from the date of injury or date of knowledge (whichever is the sooner) in which to make a claim and issue proceedings.  If you fail to issue proceedings within the three years, then you become time barred from making a claim.  The exception on this time scale is for juveniles and those people incapable of looking after their own affairs.

So, unfortunately, I am afraid you would not now be able to make a claim unless you can prove that your date of knowledge was inside the three year period, which from what you have stated appears unlikely.
