injury claim advice needed

I was just looking for some advice for a friend.

A friend had an injury back in early 2008 where his wrist was crushed at work.   After three years of medical reviews by an orthopaedic specialist, it is deemed his pain and restricted movement is permanent and nothing can be done.

The PI solicitor started court proceedings a few months ago as it was coming up to three year deadline.  My friend is expecting about Â?30,000 in compensation but then he got a letter from the solicitor saying the orthopaedic expert said he is deemed disabled since his accident under the terms of the Ogden 6 Criteria.

He lost his job after injury and is now working in a job with Â?5000 pa net less income as he cannot do manual work any more.     When I looked into Ogden 6 for him and put his details in an online PI calculator, his future loss of earnings came out at over Â?200k.   

He does not expect this to happen, but he wanted to know if, going on the info given, the solicitor will use Ogden tables to calculate damages.

Also defendants have accepted full legal responsibility for accident but have not offered any settlement.  Do cases like this tend to go to court?

Any advice appreciated

Hi the ogden tables are used by the judges and lawyers alike subject to discounts for various factors.If Liabilty has been accepted you could ask your solicitor to ask for an interim payment as this is likleyto be a significant claim, well in excess of 30k.His residual loss of earnings at 5k per annum might also be significant and again depend on various factors.Also if his abilty to do DIY and gardening claims has diminished and he did them himeslf before the accident, he may be able to bring a claim for this and also for any medical treatment and other help in the home such as care provided to him by relatives etc.

If they haven't offered a settlement then tell him to keep fighting it, his solicitor should be the one telling him to do this!
