do i deserve more?

Hi,
I had an RTA more than 3yrs ago. I  am suffering with permanent symptoms and suffer with severe pain in my neck and right arm. Although i was not working at the time of the accident,but this has affected my potential career which involves using my right arm. I am at this point getting an offer close to what my Solicitor had filed for, which I now think is not adequate. Can i  hope to receive more if i go to court? i have recently been to see the defendent's medical expert,but have been told that his report will not be as supportive as my medical expert, so this present offer maybe lowered.
my condition is actuall getting worse and i'm really worried about my future. Do you think i might be offered a better offer, more than we asked for if I pursue the case ?  before we go to Court? unfortunately, my Solicitor is not very helpful and i get a feeling he just wants to get it over with!

Hi TB

My best advice is to listen to your solicitors.  Anyone who tries to tell you they can advise you would be lying to you as the advice is specific to your claim.

There are many scenarios that can pan out when dealing with claims.  It is not always correct that the defendants medical evidence will be worse or less supporting than your own.  If it is your solicitors can ask questions as to why this is the case and the experts could also be called to a meeting together to discuss their diferences.  Dont forget each expert has a duty to the court NOT the person paying their fees.  If his opinion differred significantly from that of your own expert they would both have to explain why TO THE COURT.....NOT whoever is paying them.

I hope this reassures you.  Ask your solicitors to obtain a barristers advice once the next medical report is in or indeed now if you feel the offer may put you at risk.
