Third Party Insurers or Accident Management Company

I was rear ended just over a week ago.  The other party has admitted liability.  I contacted my insurance broker who rather than advising me to contact my insurer (I am fully comp) gave me the number of an accident management company as it's a non fault claim.  This way it won't affect future premiums - so I'm told.

I have suffered an injury as a result of the accident which I have given the details of to the accident management company.  They have assigned me to a solicitor firm who have sent me though a whole batch of legal paperwork to sign and return. It seems to be a no win no fee set up and they talk about fees etc. 

In the meantime the third parties insurance company have sent me a letter to confirm that their client has admitted responsibility and that they want to repair my vehicle, provide a courtesy car and if I have any injuries look in that as well.

I'm confused as to what the best course of action to take is.  Should I continue with the accident management firm or deal directly with the third parties insurers?  I'm worried that by staying with the AM firm I'm going to end up paying money out somewhere down the line. 

Any advice would be appreciated.

Hi Anna

Sorry to hear about your accident.  Dont worry, there is nothing wrong with using an accident managment company if you wish to do so.  The only thing you ought to do is deal with the third party's insurers for the repair to your vehicle and replacement while the repairs take place, otherwise you will be given a credit agreement by the management company and they will recover the cost directly from the insurers, however this can be a long drawn out process.

My advice however is to allow the Accident Management Company's solicitors to continue to deal with your injury claim.  My reason for this is that they will provide you with professional advice regarding the value of your claim and will take away the stresses of you dealing with it.  It can be a complicated and drawn out process and the solicitors costs will be paid for by your oponent's insurers. You will not have to pay anything, but confirm this with the solicitors and make sure you will get 100% Compensation also and the Accident management company dont take any.

So in short: -

Let the other partiy' insurers deal with the damage to your car and provide a replacement.
Have the Solicitors deal with your personal injury claim but check the following:-

1.  It is NO WIN NO FEE and their costs will be recovered from the opponent when you win the claim
2. NO ONE takes anything from your compensation at the end of the claim and the cheque for compensation gets sent DIRECTLY to you and not via a third party ie the Accident Management Company.
