yogurt slip

Two days ago I had an accident in a shop. I was walking with my shopping basket, looking at the food on the shelves and I suddenly slipped on something greasy what later turned out to be a spilled yougurt. Injury - sprained ankle
And here is my question: can I claim for compensation from the shop??? What steps should I take in order to get it?

Hi Sandy

Hopefully I will give you advice as to how to claim and what you need to do unlike the above post!!!

I am sorry to hear that you have been hurt firstly.  In terms of making a claim you need to have done the following things.

1.  Reported the matter in the accident book at the shop

If you have not already done so, while the matter is fresh in the employees mind,s make sure you go and have the matter recorded in the accident book at the shop.   Ensure that within that entry they record that the reason for your slip/fall was due to spilled yoghurt.  A lot of places just put slipped or fell withour any details as this assists them with putting forward a defence to the claims.

2.  Any witnesses to the accident?

Make sure you have their details recorded somewhere so they can be contacted if you have them.

3.  Go to the Dr's or the Hospital.

In order to make a claim you must make sure that your injuries are recorded within your medical records as these will prove you were injured as you say you were.  Without these we can not prove your injuries were as a result of the accident.

4.  Contact a solicitor.

Solicitors will work on your claim on a no win no fee basis which means you pay nothing at all providing you abide by the agreement with them.  You ought to also receive 100% Compensation as a result of the accident. Anyone who says they will make a deduction from your compensation or charge you anything for making the claim you should avoid like the plague!!

I hope this helps.  If you would like more information either contact us by clicking on our link below or our ad to the right of this post and we will be happy to have a chat with you with no obligation at all.

We (FloorSlip .co. uk) specialise in Floor Safety and we would make the following comments to help you (a) Did you report the incident to the Manager at the stores and was it put into the accident book? If not, then do so as soon as possible - any slip injury claim will be strongly argued if you leave it too long; make sure you and them sign the accuident book (b) You can ask to see the results of the Pendulum Testing of the floors, which detects how slippery a floor is - The value must be 36 when dry, wet or contaminated with substances typically found around that floor (for example - milk). If the store can not produce them or the value when wet or contaminated is less than 36 then there are very good chances you can claim for a slip injury (c) If you wish to be put in touch with a personal injury lawyer that specilaises in this type of slip injury accident claim then contact us; we are independent floor safety consultants and deal with many solicitors and lawyers who specialise in this type of dloor slip event - Regards, Mark 07735 570404
