What if the employer doesn't want to recognize the accident?

My sister worked in a small factory in Scotland. Last Monday she had a serius accident; an unsecured loaded platform fell on her. As a result, she has been seriously injured. She had a surgery and is still in the hospital. She was hired off the books and the employer doesn't want to recognize this accident as an accident at work... Is there a chance for getting an indemnity?

Hi Melanie

Yes indeed there is, there are many options available to your sister the first would be to report the matter to the Health & Safety Executive, this will ensure there is a formal report of the accident.  Further ensure that there is a report in the hospital or GP records as to exactly how the accident happened.

If there were witnesses to the accident ask if they would support the fact that the same took place.  Thirdly instruct a firm of solicitors sooner rather than later to get involved.
