fresh driver's problem

Hi,
I have a question... 3 weeks ago I was injured in a car accident. A woman drove into me. I have my driving licence since January 2011, so I am a fresh driver. Although the guilt of the woman is evident, the police still haven't assesed the guilty party. There were no witnesses to this accident. I am afraid that, taking into consideration my "freshness" they will accuse me of causing this accident. What should I do???

Just because you have just started driving does not mean you were negligent in causing the accident.  Negligence is judged on the circumstances of the accident and the lead up to it.  You have not given enough details to be able to provide you with any kind of opinion in relation to who was at fault for the accident.  Please provide more information as to how it happened. 

Make sure that if the circumstances of the accident are difficult for you to explain that you draw diagrams and take photographs of the area for your insurers so that they have a clear understanding as to what has gone on.

Yes.  Most insurance cnopamies use similar verbage on their application documents which ask for you to list all accidents and citations you have received.  At fault accidents and citations remain chargeable for up to 3 years from the date of their occurrence; however, on one of your previous questions, you indicated that you are attending school in PA and may claim CA residency.  My advice is to try and maintain your CA policy unless the rates in PA are substantially better.  Also, if you don't reveal the accidents to your new carrier, they will find out anyway because your CA insurance company paid for them.  Almost all insurance carriers are members of CLUE (Comprehensive Loss Underwriting Exchange).  This is like a credit report for your vehicle and driver's license that will pull up any and all losses that were reported to an insurance company and will indicate chargeablilty and amounts paid on claims.  If you new insurance carrier believes that you are guilty of gross misrepresentation, they may cancel your policy short term or even rescind it if they can show that your driving record would not meet their underwriting guidelines.

Most of the time, yes they will find those prior claims.Many isrnnauce companies participate in a national database that tracks claims. They will also check you MVR records of any tickets or accidents. It is very difficult to slip one past an isrnnauce company.Fraudulently stating fewer claims than you actually have is not a good idea. If you filed another claim and the prior ones were discovered, they could deny the new claim, back charge you a higher rate, and/or cancel the policy on the spot.Because your rate went up due to the claims, it's not a bad idea to shop around, just make sure they are rating you with knowledge of those prior claims.
