Involved in a car crash
Hello,
My name is Adam Davis, 21 years old and just looking for a bit of advice before I take anything further...
My friend crashed his car into a lamp post at around 50mph, I was dragged out of the car under a complete state of shock and it wasn't until I was getting dragged into the back of an ambulance that I really knew what was going on.
A week before I had just come out of a kidney stone operation (I had/have a meter long tube inside me running from my bladder to my kidneys, this is to prepare me for the next operation) and felt severe abdominal pain for about 3 weeks after the accident. I was put into a leg cast with a fractured foot (although the doctors wrote it down as 'left proximal phalank, fracture of big toe') and then two weeks later moved into a foot cast for a total of 22 days. Now I am still on crutches and advised to put as minimal weight on my foot as possible for a minimum of 3 weeks. I also suffered minor whiplash, a painful back, sternum and ribs. I could hardly see anything when I was pulled out the car as my vision was all blurry and I was also majorly winded. I was passing blood in my urine (symptom of the tube) but it had cleared up initially before the accident and was becoming more severe, I did urine sample tests for this but still have not heard back from my doctor.
At first I had a lot of discomfort in my ribs and especially my sternum, when moving about, climbing up stairs...even as stupid as it sounds, hiccuping!
I have been offered Â?2800 compensation for the injury and as I was more worried about my foot, brushed aside all the other issues when I was being brought into hospital so I don't know if they will be on my records.
As the insurance company is going to check my medical records, do you think I should go to the doctor and tell him I am still suffering from these problems (which I still am to an extent) or should I wait to see if they will adjust the claim when they see my records as it is? I told them everything I have told you but i'm worried that if they do check my records the things I did suffer from won't come up. Also as I told them I have a fractured foot when the doctor has wrote it down ultimately as a broken toe even though I was told it was my foot and all this fancy terms I have no idea what it means!
I am also suffering psychologically, I have only recently passed my driving test and I can't even sit in a car now without getting majorly freaked out (especially with the way my dad drives), I'm just worried im going to be very much uncertain and nervous when i'm back on the roads!
I'm not looking to claim yet, but I would really appreciate anyone who can help with my questions and if someone knows if i'm being exploited or if it's a good enough amount to take. This is minus loss of earnings, so anything that gets put on top will be for that reason.
I'm thinking of book a doctors appointment tomorrow to tell him about the issues hopefully sometime during this/next week.
Anyone that can help a young guy with absolutely no experience would be greatly appreciated. As for help with your advice, if you'd like to leave your numbers in case I do claim, i'd appreciate it. If your replies can be non bias to your job initially it would help me a lot as I really have struggled since for nearly 2 months and I don't want to be in a position where if i do take it to court, I could lose.
Thanks so much, looking forward to talking to people more knowledgeable than me!
Hi Adam
Firstly Im sorry to hear about your accident and the injuries you sustained especially given the operation you had prior to the accident. I only have one piece of advice for you really..........GET A SOLICITOR!!!
A solicitor will deal with all of this for you and you wont have to pay them anything. Â?2800 certainly does not sound enough given the injuries you have sustained and this is especially the case as you are still suffering and may need more treatment in the furture.
Solicitors work on a No win No Fee basis, this means that when they are successful with your claim they will recover your costs from the other party. You need to make sure that any solicitor you instruct will give you 100% compensation. I promise you that you will get a lot more with the assistance of solicitors than you will on your own. It's not just about money the solicitors will also arrange for you private medical care such as physiotherapy etc. again all for free to you.
I would be happy to discuss this matter with you further, have a look through our website (below) and if we can help in any way please do give us a call 24/7.
Regards
