Tripped on a kerb of ramp on handicapped parking space

I collected my daughter from a dance class at a council facility and as I walked to my car I stepped on the edge of a ramp next to a handicapped parking space and damaged my ankle badly. The edge of the ramp had been painted the same colour as the lines of the parking space and could not be seen from where I was standing. The ramp and carpark surface were the same colour and the edge is over 3 inches high.

Since the accident they have painted it a different colour and written the word Kerb on the edge to prevent other acccidents.

I could not walk for 2 months and now I have arthitus in the ankle. Suffer from depression and I was recovering then this set be back to square one.

I don't feel this is my fault. Can I claim against the council?

I have photo's of before and after.

I meant pictures of the kerb before and after. I received treatment from the hospital for 2 months and 8 months on I am still in pain.

I am sorry to hear about your accident and hope you start to feel a little better soon.

Certainly it may be worth investigating making a claim a little further and indeed I would suggest you consult a solicitor who may be able to help.  You may wish to consider our website below or click on the ad to the right of this post.

In terms of dealing with a claim of this nature they tend to be very tricky however the fact that the council/owner of the carpark have since marked the area showing and warning of the hazard this will obviously go in your favour.  Most councils or local authorities will not spend money if they dont need to.

I assume that you reported the incident to the council after the accident or the people that run the dance class which is what prompted them to paint the kerb?  Could you confirm?

The photographs will certainly help you when making a claim.  As well as obtaining financial compensation you may be able to obtain rehabilitation on a private basis also, this could include physio and also some counselling to assist with the depression.
