Injury at work

I had an injury at work 3 weeks ago. This was due to slipping on a wet and oily patch on the floor of the warehouse. I have injured my lower back and injured my left knee. I have to say I have a knee replaqcement 3 years ago on this knee. As I am still on a probationary period with the company, I think that they are giving me an hard time or just tring to get rid of me.What do you think I should do. As my doctor has declared me unfit to continue with this work and I am 64.

Mog - Whislt technically your employer cannot dismiss you for making a claim ,in reality some employers are not happy when claims are made and so a claim could mean that you are not given a permanent position at the end of your probationary period.

You have got 3 years from the date of the accident to take a claim to court (although I would not advise waiting that long). But it does mean that you have got some time so why don't you see what happens at the end of your probationary period before instigating a claim?

You can still instruct a solicitor in the meantime, and I would advise you to do that, but tell them that you don't want the claim to be submitted at the moment.

In the meantime you should ensure that the accident is in your employers accident book and gather any other evidence that might be relevant - photographs, witness details etc.

Hi Mog,

I hope you are recovering well from your injuries and things are getting a little better for you.  As Martyn has said above technically your employers can not sack you or make you redundant for making a claim for personal injury.  However if you are unfit to carry on with your job then they may be able to make you redundant due to this.

However I think your concern should really be how the injury is affecting you, if you are unable to return to work and indeed as a result no doubt losing earnings then making a claim for personal injury may actually help you more than hinder you.  Making a claim for personal injury is not simply for monetary compensation.  As a part of the claim you are also able to obtain private medical care, therefore if indeed the injury has made your knee replacement more painful and further surgery is required in the future you will get this done without the need for waiting on the NHS waiting lists. 

In addition to the above if this accident has renderred you unable to work you will be able to recover future loss of earnings also, however this may be limited to the statutory age of retirement however if you have a strong claim that you would have worked longer then this will be considered.
