Claim settlement

My wife has just accepted a part 36 offer in settlement of her injury claim, her solicitors have informed her that they expect the cheque to arrive in 4 to 8 weeks time. Is this right? as It states on the ministery of justice 's web site that a accepted part 36 offer has to be paid within 14 days.
Please can anybody HELP.

Paul your soliciotors are probably just being cautious. Accepted offers are normally paid within about 3 weeks but sometimes things go wrong at the insurance company (who are usually issuing the cheque) and it can take longer.

I am sure your wifes cheque will arrive soon.

I work in personal injury law and things can still take time.

My daughters claim was settled in October 2010, and here we are in March 2011 and she is still waiting for her cheque despite numerous chase ups.

If you have not hears anything or received your cheque after about 6 weeks, get your solicitor to start chasing, and if needs be threaten to refer the matter to the Financial Service Authority, this usually gets things moving.

Hi Paul

Be patient the cheque will arrive in good time.  Most insurers are cautious with their timeframe and solicitors even more so.  If the solicitors said you will have your cheque in 14 days most clients will call on the 15th day if the cheque is not received.  Obvioulsy as you know your solicitors will have lots to do on others claims too so having to deal with chasing cheques would take a long time.  However every solicitor will have a diary system and if your cheque is not in within good time it will be chased.

As mentioned above if you have not heard from the solicitors or insurers with your cheque after 4 weeks or so chase them up and ask them to call the insurers to see what the issue is.  It may be that the cheque got lost in the post which sometimes does genuinely happen.

I agree if the cheque does not arrive within the amount of time the solicitor says that it should you should contact the solicitor. You might have to contact the insurance company also that is issuing the cheque.
