fall at work

hi. i had a fall at work approximately 4 years ago with a previous employer. i wrote the details of the fall in accident book and this was signed by witnesses. at the time i felt no pain in my knee although it took the full force of the fall. the accident was due to standing water on the bathroom floor and this was highlighted in the report.
4 years on my knee now causes me considerable problems and i am sure it was a result of this fall- i knocked my knee from a standing position on to a skirting board.i have yet to visit the doctor to highlight what is wrong with my knee
i would appreciate any advice on how to proceed as i do not have the date of the accident and no longer work for this employer

Hi Paul

Unfortunately it sounds like your chances of being able to claim are unlikely.  Limiation for a personal injury claim is 3 years from the date of the accident.  NOT unfortunately date of discovery of the injury/problem.

In order to claim you would also have had to have reported the accident and you injuries to the hospital or Dr at the time or within at least 6 weeks or so of the accident.

If your accident was within 3 years and was reported to the hospital or Dr at the time then you may be ok and obviously could look to claim.  The easiest way to check the date of the accident if you did visit a medical prectitioner is to simply ask them to consider your medical records and this will give you a very clear idea.
