Solicitors are useless - have not done anything for over a year

Hi all,

My girlfirend and I were severly injuried in a RTA 24/12/08

Our solicitors were provided through our insurance. We contacted them today and it seems our solicitor has changed.  When we spoke to our new solicitor she informed us that my girlfriends claim/details have not been updated for over 1 and a half years, despite my girlfriend having regular phone conversations, sending several emails (injury updates) and an operation within this time period.

I find this completely outrageous and unacceptable! Our old solicitor has not done anything to aid our claim. If anything, she has hindered it. I am extremely unhappy about this.

However, i am unsure of my rights regarding this. One thing i said to my girlfriend is, next time she speaks to our solicitors she should demand any earnings they have made during the year and a half as they have done nothing, zip, zilch!!!

Please, help! What rights do we have? I feel like because of this we will possibly be given less compensation in the end - if thats true, that is completely unacceptable

Ed - if I was you I would find and instruct a solicitor of your own choice who you belive will act in your best interests.

You are perfectly entitled to do this.

If you came to me the first thing I would do, on your behalf, is to complain to the solicitors and your insurance company about the way you have been treated.

You are not the first person who I have heard complaining about service standards at solicitors appointed by insurance companies. My advice is always to choose your own solicitor don't let somebody else choose them for you.

Hi Ed

I completely agree with Martyn.  The issue is that the solicitors appointed by insurers tend to get volume work from insurers, ie every claim they have is passed to the same solicitors.  Unfortunately this is becoming an ever increasing problem especially since April 2010.  What this means is that the solicitors firms employ a large number of paralegals without the appropriate level of assistance from seniors and they push claims through a kind of sausage factory with no care for the clients at all and unfortunately you are sufferring as a result in terms of service.

Contact Martyn he has offerred his assistance and hopefully you can get on with your claims and progress the same accordingly.  If you do not wish to then please contact your solicitors, find out the level of the fee earner (claims handler) that is dealing with your claims and insist that the matters are referred to a more senior person for continued handling.  This may progress the matter for you, but I would consider getting out if you feel comfortable doing so and accept Martyn's offer.
