Cycling accident

When riding to work I came off my bike due to someone removing a paving slab from the path at the end of a bridge. The path is generally in poor condition and many of the slabs are loose, however they are very heavy and would have taken quite a lot of effort to remove. The street lights along the path are not working (I complained about this in the past) and as it was early in the morning it was dark and I could not see the hole.

Because the part of the path was still part of the bridge the made ground was approximately 1.5ft lower then the level of the slab so the front wheel fell down a considerable way throwing me over my handlebars. I broke my wrist and damaged my bike.

I contacted the council and they say they are investigating the incident. However I recieved a letter asking me how often I used the path prior and since the accident and am unsure how to answer this question as I do not understand the relevance. Please could someone advice as to the relevance of this information. Thank you.

I would advise that you consult a solicitor. Council's and their insurers can be quite difficult when dealing with this type of claim.

I am sure that you will be able to find a solicitor to take your case on a "no win no fee" basis so you've nothing to lose.

I would certainly be happy to deal with a case such as this.

Sorry to hear about your accident.  As explained above the use of a solicitor for this type of claim is generally free and will be dealt with on a No Win No Fee basis which means you will pay nothing whether you win or lose. 

The area of law surrounding your type of accident is often very tricky and the Highways Authorities are generally very good at putting forward defences to claims which are difficult to understand and interperet so as to scare both claimants and solicitors into not proceeding with claims.  Often however there are flaws within the defence that with a little investigation can weaken the defence considerably. 

The issue you have is that one day the slab was there and the next it was not.  Generally acts of vandalism is something which even the councils can not control.  In order to succeed with the claim you would have to demonstrate that the council was negligent in someway.  If may be that workmen were in the area on the day of the accident or shortly before and failed to replace the slab accordingly, if this is the case then the cliam could be directed towards the contractor and therefore you have a better chance of succeeding.

As it is relatively difficult to find a solicitor to deal with this type of claim I would take Martyn up on his offer above and have him review the matter further.  I am sure he will work on a No Win No Fee Basis and you will receive 100% of your compensation.

I agree with what Matthew has to say. You should have Martyn up on his offer. If he finds that there is a claim I am sure he will want to take the case on. If he finds there is not then I think you are pretty much dead in the water. Hope it works out for you.
