will anyone pursue my claim?

Hi,I have just spoke to my solicitor who has just told me he is not going to pursue my claim against Royal mail.
he has said it is because of two statements(one by my employer/other member of staff,another by a cwu rep)neither of which
I either said nor were signed by me.I have since found out that because of these "statements" that comments in these are why he will not continue.My accident involved me coming off the bike(faulty handlebars) and fracturing my left clavicle,which I have
had two operations and a metal plate fitted,pain still continuing.The accident occurred in February 2010.
Can I still pursue this claim through another solicitor?

Without further information as to what the exact cause of the accident was, it is very difficult to say whether your claim would be taken on by another law firm, as it all depends on the evidence and the circumstances.

However, a statement made by your employer or work colleague could be considered as being in conflict or even thought of as hostile, and therefore would not carry as much significance as a statement made by someone who is totally independent.

Most law firms will offer a free consultation, so call in and visit or give one of them a call and have a chat, you have nothing to lose.

Sorry to hear about your accident.  It sounds like you are not getting very far with your claim for whatever reason.  The first thing that springs to mind is the fact that your accident was caused by what sounds like defective equipment ie the handle bars broke?  This case sounds very much like Stark -v- Post Office where the postman was on his bike and the front brakes on his bike snapped causing the wheel to lock and him to fall from his bike.  Very famous case in terms of PI Law and your solicitors ought to be aware of it. Google Stark -v- Post office. Sounds like the claim is on "all fours" and should be a winner.

Notwithstanding the above with the very little information you have provided it would be difficuly to advise you accoridngly.

Please provide more information about how the accident happened and what was said by the witnesses.
