I tripped on some defected paving which caused me to damage my leg badly. Subsequently I was unable to work for a long period of time, as I am self-employed and working in construction. I contacted a firm I believed to be competent in this area of personal injury and provided evidence of my accident, which included photos of the defect and witnesses to the defect.

The council disputed liability on the grounds that reasonable site inspections were in place at the time in question. They provided me with the inspectorâ??s log which does show inspections took place. The issue that I have is that residents on the road where the accident took place have told me that the defect had been there for a long time. Two residents reported the fault but nothing was done.

My question is that the fault had been there during at least one inspection yet was not detected. So either the inspection never took place and is a fabrication, or the inspector was not competent and was not doing his job.

How can I prove that the council is liable?

Hi Jason

First of all sorry to hear about your accident.  Despite the fact that the Highways Authority have denied liability for your accident based on documented logs there are arguments that will assist you with your claim.  You have been very diligent in asking residents regarding their opinion on the defect and the amount of time it has been there.  If indeed the matter was also reported to the council then my strong suggestion is that you get your solicitors to take full and detailed witness statements from these residents for the purposes of disproving the defence.

Whilst we can never state that the inspecitons did not take place, as obviously there are logs to confirm that they were, the argument would be that they were not undertaken with the due care required so as to identify the risks.  One very important thing to check is whether the inspections were by foot or by car.  If by car it can be argued that parked cars, litter and othe such obstacles clearly obscured the view of the inspector.  If walked, then he clearly failed to identify a dangerous defect as being such and therefore was negligent.  You state that the defect appears on a log but was not repaired.  Was this before or after the accident?  If before, again this is your chance for breaking the defence if after is the defect still there?  If so again they have failed to act on thier own systems.

The most important asset to your cliam however will be the witnesses try and tie them up accordingly and disclose their evidence.  Your solicitors will want to do this so as to protect the amount of costs they have put in so far a little more will not hurt.

When you said you fell on a defected pavement.  Did you measure the trip in question? If its under 20mm you wouldn't stand a chance anyway. Most residents will state a flag footpath is dangerous when it is just cosmectic.

So I live with my parents and my mom's sister. I really don't get along with my aunt so we don't speak. Whenever something of mine gets broken around the house.. my aunt is the one at home yet she doesn't tell me anything. I find out about it like a week later. I tell my mother about it so she can speak to her sister.. My mom instead goes against me saying that I like to look for problems.. This happens often and many of my things have been ruined because of it. My dad when he tries to speak to my aunt my mother also goes against him and they argue.. I don't know what to do anymore.. I blame my parents since they brought her to begin with.. but what could I do.. My mom feels that my aunt is the victim and that we are just mean..

Hi

If there are 2 local residents that can confirm the defect has been there for over 6 months - then we can assist.

In similar circumstances we get something called a s.58 statement done, so the council can not used s.58 of the Highways Act to defend their claim.

It may be the case the inspector failed to report the defect.
