hi,   i recently got into a little accident,
i went round a corner too quick and the back of the car spun out,  which caused me to swerve into a bush,

i rang police they came took down questions that was it,  i got recovery to pick my car up.
now a month a half later i get papers through the door saying i need to go to court for dangerous driving
section 2 of the road traffic act 1988 and schedule 2 of the road traffic offenders act 1988.

the question is, what sort of punishments am i going to get for this? i wasn't doing double the speed limit it was like 45 to 50 in a 30
i was honest with the police  and no one else was involved

this is my first year on the road, its been fine till i made this bad call.
i cant afford to loose my license because the work am applying for is 30 miles away.

To prove the section 2 offence of dangerous driving, the prosecution has to show that your driving fell well below that expected of a reasonably competent driver, and to be honest a prosecution usually only occurs in the most serious of circumstances.

However, the Police will usually report for both dangerous and careless as they cannot increase the offence if you were only reported for the lesser offence and evidence then comes to light that you may be guilty of the more serious offence.

So in your case, the prosecution may well decide to go for the lesser offence of careless driving contrary to section 3 of the road traffic act 1988.

The offence of dangerous driving is second only to causing death by dangerous driving, and carries a mandatory disqualification (up to 14 years) as well as the option of imprisonment but this would mean the case going to the Crown Court for sentance.

You really need to speak to a specialist traffic solicitor.
