Impossible question, but need guidance please.

Hi All!
This must be a really popular but tricky question but I thought I'd ask just incase.

I was in an RTA back in May this year. The private GP my solicitor sent me to has recommended 8 months of physio for my wrist as he thinks I've torn some tendons. I also had whiplash for about 3weeks, disturbed sleep for a couple of months, and a knee injury for about a month.

How do they work compensation claims? Is it an amount per injury? Or do they assess the various injuries as one and make an "overall" offer?

Also, does anyone have an idea of an approximate amount of compensation I can receive? It's not something I want to ask my solicitor incase I come across as greedy or whatever. But i've just lost my job you see and was wondering how long whatever I get will last me while I find work.

Any help would be appreciated.

There are two parts to the claim.

The compensation for your injuries is called general damages.  Each injury has a value and this value is dependant on whether it is minor or major.

There are then what is called special damages, and this takes into account your loss of earnings, out of pocket expenses, damaged property and so on.

The two are then added together and an amount is arrived at, although this is a very simplistic explanation, your solicitor will in due course prepare what is called a schedule of damages, and this will include everything mentioned and more beside as you also get a payment for pain and suffering as well as the actual injuries themselves.

It is impossible to provide an estimation of the amount you are likely to receive as no two cases are the same, but don't worry about asking your solicitor, he/she will be (or should be) happy to tell you the sort of value they will be seeking from the other side.

I agree with the above post.  I could elaborate a little further, in answer to your question regarding your injuries no you are not paid per injury and indeed General Damages as mentioned above are a single payout taking all of your injuries into account.

Hope this helps, always be guided by your solicitor and dont be afraid to ask them these types of questions they will be able to answer them specifically in relation to your claim.  All we can do is give general advice.
