PTSD compensation

I was involved in an accident in September 2008 which resulted in me having whiplash (which exasberated existing injuries) and PTSD.  I under went 10 sessions of treatment to address the PTSD which failed.  I was re assessed for a Psychiatric report in September 2010 (2 years after the accident) which states that I still have PTSD (Moderate level) and have developed Co Morbid Depression to a major degree as a result of the PTSD not being cured.  It has also been recommended that I undergo a further 12 - 20 sessions of treatment to address the PTSD and Depression, that currently my prognosis is good but that it cannot be guaranteed that I will fully recover.

My solicitor is stating that currently I should expect to be compensated between Â?3000 - Â?5000 for the PTSD element and Â?1800 for the whiplash injury.  He has said this is based on the Judicial guideleines but when looking at this web site others seem to be recieveing considerably more.  I have looked at legal firms web sites that suggest more should be awarded for the PTSD.

My solicitor has suggested that I undergo these sessions and then he seeks a further report from the practitioner to seek a clear prognosis.  I will of course currently follow this advice as I want to get better.  But are the figures he is quoting correct and can I approach the law society to gain their guidelines?

The figures quoted are just that "Guidelines" and simply provides an indication as to what an injury is worth.

No two claims are ever the same and the overall value will depend on the severity of the injury, the personal circumstances of the individual concerned and other relevant facts.

There are also upper as well as lower limits not to mention the inbetween limits which is why the independent medical report is so important as it will give a long term prognosis which is by and large how a case is valued.

If you feel that your solicitor has undervalued your claim, you are entitled to change firms, but I would suggest that you speak to them first and express your concerns, and remember your solicitor cannot accept a claim on your behalf without first consulting with you and providing appropriate advice.
