RTA claim

I had a RTA in August which is still to be settled.  I was reversing out a parking space, had done all my observations and stuff.  My car was fully across the middle of the road and was stationary.  I was about to go into first gear when the third party reversed out at some speed and crashed into the rear corner of my car.  The third party was verbally aggressive and at the time refused to give me his details.  I had to go into the shop to ask if they could call the police.  When I then told the third party I had called the police his attitude totally changed and he finally gave me his details.  I am now so frustrated with the whole process.  The third party want a 50-50 liability!  I feel as if my lawyer isnt really fighting my corner and I am not accepting any liability!  Can anyone advise me on my claim and what I could do.
