Medical negligence - diabetic overdose for 4 years!

I am thinking about taking out a medical negligence claim for my father.

He has been an insulin dependant diabetic for more than 15 years now - four years ago he was told by the consultant to inject a certain insulin 3 times a day and a different type at night.  Six months later his GP changed his medication but didn't tell him to change the amount of times etc.  So Dad plodded on for the next four years.

In July of this year he had two "hypos" resulting in my mother having to call for an ambulance as she was unable to bring him round.  Dad visited his new GP and expressed his concerns - she is great and refered Dad back to the consultant.

The consultant stated that Dad should not have been taking the day time insulin three times a day, but only twice, he certainly should not have been taking the quantities he was and the day insulin should never be taken with that type of night time one - resulting in Dad effectively overdosing on insulin!  No wonder he was having "hypos" - any of which could have killed him as he was asleep when he had them!!!  Dad is 5'9" tall and of slight build at the best of times but his weight fell to 50 kgs!  He wasnt sleeping, eating and was becoming depressed.

The Consultant stated that he was going to inform DVLA and ad's driving licence as revoked.

Over the last month Dad has been on a new regime and has put on over a stone, is sleeping better and is eating properly - he states that he feels so much better and has more energy which is all fantastic.

The DVLA will consider renewing his licence in a month or so, but the more I think about this situtation the more upset I become - my Dad has been given regular prescriptions for his insulin and the old GP has never once thought that he is using too much or that the types of insulin were wrong!  His health has been severely affected for years now and he has lost his independance.  I think the GP has been negligent in prescribing the wrong medication and too much of it without reviewing how my Dad was getting on.  What do you think?  Any advice would be appreciated.  Thanks Heidi

Hi,I'm also looking it to medical negligence!!!
11 years ago when i was only 18 I gave birth to my beautiful daughter.I had her naturally...no drugs!
I remember the midwives looking confused and worried when my placenta didn't come out after the injection...but instead of seeking advice she pulled my placenta!!immediatly I started bleeding.....the midwives brought in a gp and I was rushed to an operating room.the surgeons worked on me for around an hour to stop the bleeding whilst I was awake!which they couldn't!
They had no other choice but to give me a hysterectomy to save my life!!
My placenta had fused itself to my womb which was why it wasn't coming out..but whether it was because of this or not the midwives shouldn't of just thought they'd pull on it!!!it's left me baron for the rest of my life when I feel this couldve been avoided some how!

Have I left it too late to look in to it?

You may well have left it too late.

To make a claim proceedings have to be issued within 3 years of the date of the injury or date of knowledge whichever is the sooner otherwise youe claim becomes time barred.

It would all be dependant on when you actually found out what had happened or when you were told what had happened.

If you are outside the three years since you became aware or the problem (which it sounds like you are) then you would be time barred from makeing a claim unfortunately.

My sister was studying law at the time and she wrote off to the hospital to get all my notes.but at the time I didn't have the
money to pay for all 450 records they had.plus sitting in the depths of depression for the last 11 years meant I couldn't face
stirring it all up again!
I have heard there are specialist that deal with cases from more that 10 years ago.is this right??

Any clinical negligence firm will deal with cases regardless of age, but it still has to comply with the statutes of limitation.

The NHS are only allowed to charge a reasonable fee for medical records, usually around the Â?50 mark, so if you were quoted Â?450 someone saw you coming.

If the case is 10 years or more old and the injury was known about that far back, then regardless of what anyone states, the rules still apply and could falsely get your hopes up.
