I was injured as a result of RTA. Do I have to claim loss of earnings

I was injured over 3 years ago in a RTA.  Can anyone tell me if I have to claim loss earnings as I only worked part time and the amount of benefits I received exceeded that of what my wage would have been.  Can I just claim for injuries sustained and have the relevant medical evidence produced or is it not as easy as that.  I do have a Solicitor whom has been very good but I thought that I would use the forum rather than ring him to asking all tiny details as he is very busy and don't want to pester him over every question that comes to mind.

You can claim loss of earnings too. Your solicitor will ask for your income statements for 3 months and then take the avarage ammount you would have made in the time you had to take off work.

e.g if you make Â?1200 over 3 months. So avarage= Â?400 per month.

And you were off work for 1 week, you would be able to claim Â?100 for loss of earnings.

If you received benefits or pay whilst you were off sick, then you have not had a loss which the insurers will compensate. Compensation is only made where you have suffered a loss.

You can ask your solicitor any question you want as that is what they are getting paid for - their costs are claimed from the insurers and paid on top of your award.
