slip in Morrison's

I fell in Morrison's supermarket last November (2009). I slipped on a wet floor at the end of a refridgerated area within the store.  I sustained a soft tissue injury to my right knee and a soft tissue injury and partially prolapsed disc to my back. I attended A&E and my GP. I was on crutches for several weeks and now wear a knee support I have had physio for my knee but I am in pain nearly every day and I am still having physio for my back. There were no warning signs in situ and although the incident was witnessed by people shopping and who came to my aid initially, because of the pain and distress I was suffering I did not even think about taking their contact details. The incident was recorded in the stores accident book, however from the onset the store disputed that there were warning signs out....there were none.... and one of the ladies who came to my aid pointed this out to the person filling out the accident book.....he seemed to dismiss this and was disinterested. I have pursued them for compensation....they currentlly are denying all liability. I am looking at having to go to court to get justice even though they have been negligent in their duty of care!!! A barrister is currently reviewing my case to establish it's probable sucess and in the absense of additional witnesses my credibility as a witness!!!! My credibility!!! I feel like I am a criminal and now I have insult to add to injury!! I have had to alter my entire life....I don't do what I used to.....I've changed my job because I could not drive for long periods and in my job as a nurse I could not bend down/kneel etc, I used to love walking my dogs for miles, chasing round after my grandchildren, even simple things like getting my socks on are a problem now!!!!  Will I get the justice I seek? Will I get the compensation I deserve?

Like you, I have had a very similar experience with Morrisons.  And I too have been made to feel like a criminal after being told by my solicitor that Morrisons say it didn't happen and therefore they state there is no chance of success.  Rubbish!

I would be interested to know if anyone knows of a website anywhere which discusses accident claims against supermarkets.  I was claiming against Morrisons after slipping on a wet patch on the floor.  I had a photo and everything and Morrisons offered to call ambulance and provided me with a chair etc.  However, my solicitors now tell me that they won't pursue a claim because Morrisons deny liability. Well of course they are hardly going to jump up and down shouting we did it are they>  I sustained quite a nasty twisting injury to my knee which necessitated a visit to the hospital.  I don't see how anyone can just turn round and say, nope, they say they have a clean as they go policy and therefore they must be right!  I nearly took the woman in front of me down at the same time when I fell but, due to the behaviour of a member of staff (who I believe has subsequently been sacked), and the lack of immediate assistance from staff when I was on the floor, the lady paid for her shopping and left without me getting any details.  My husband asked for a copy of the first aid book showing my accident (asked at the time) but they refused so we have no idea whether it was even entered in their book (they took the details down on a tiny scrap of paper).  I'd like to find out if anyone else has had this type of response and then been successful.  Thanks for any advice.

Hi
Hope you are on the road to recovery following your slip..
Have you contacted the Health and safety officer for your particular area...they are attached to your local council, so you might need to go through them to access one. If there is an accident where a member of the public is injured on the shop premises then the store owner MUST record the incident in their accident book and this is reported at a local level to the Health and Safety Officer who then makes the decision to investigate this further... or not. You might want to give them a ring and check that this happened, they log all cases just incase someone is seriously hurt and brings a case against the store and the store is found to be negligent in their duty of care. Which it looks like they were. Go to another legal firm that specialises in compensation claims for further advice.
Good Luck and I hope you get justice!!
