Had a crash that wasnt my fault but didnt claim

Hi,

You have probably guessed by the subject, i am not happy with what i have done.
I had a car crash last year which wasnâ??t my fault, this girl all of sudden stopped on the side of the road, not knowing what she was doing i slowed down and eventually stopped, she then decides to reverse her car into her drive way, as the front end of the car swerves out while she is reversing in, it catches my bumper and the off side wing.

Now i be (the nicest person ever) and see that she is shaking etc so i say to her that donâ??t worry about it, we will get this sorted. Next thing i know is she has disputed the claim although this was blatantly her fault. Anyways, my insurance company contacts me and ask me to fill the forms etc as i have the legal cover, which i do but then when i get the letters from the appointed solicitors and read their T&Cs i come to realise that i could be in for a long-haul so i foolishly pull out, knowing that i might be emigrating and having received the letter from my underwriters that they have not received further correspondence from third-party the case is now closed and so i assumed that i am ok to carry on my life without the stress of a court hearing etc.

I since changed my car insurance, moved home, didnâ??t emigrate and never gave my old insurance company my new address so here comes the big surprise (for me), my landlord owns both properties i.e. the one i have moved from and the one i have moved to, so he gives me the post with a county court stamp on it.

I open and find that a claim form had already been send to my old address and since i had not responded in 14 days a judgement has been passed against me by default. Now i do not have a solicitor to fight my case and over Â?1600 to pay for crash that wasnâ??t my fault. I just donâ??t know what to do.

Please if you can help then respond please please please please help!!!

You should get in touch with the insurance company who insured you at the time of the accident and explain what has happened to them. They should still cover any claim against you.

Your original insurers are required to cover you - they will simply ask for the judgement to be set aside as you received no notification and you have resonable grounds to defend the case.
