road accident involing a pedestian

hi, my partner was involed in a miner car crash , there was a man in the road acting crazy and while avoiding to hit him he crashed into an oncoming car, the person that was in the road had gone by the time the police got there but whitnesses had told police how it was not my partners fault including the man that was in the other car, so as a result there is no  to blame, now my partner is out of work for a week as a result of whiplash im wondering from these cercumstance can we claim for whiplash or as it was no ones fault are we left we no opions? any advice would be alot of help,

Hi Char

Unless you can get the details of the crazy dancing man in the middle of the man, there is no one to claim off.

The reason for this, if the man has home insurance or another type of insurance there has been known of cases where solicotors claim from such insurances.

But with no trace of this man then there is nothing you can do, unless your husband has personal injury - then you might be able to claim for injury or time in hispital etc...
