distressed automobile accident-driver hit us at a high speed
On the evening of Friday, February 13th, my son and I were involved in an automobile accident.
We were completely stopped, with our turn signal on indicating our intent to turn left, but waiting for oncoming traffic to pass, and were rear ended by the truck behind us. It is estimated that the driver hit us at a speed in excess of 55 mph, never once attempting to stop.
Our car traveled appx 40 to 60 feet from the site of impact, and my trunk is now a part of my back seat. The seats we were sitting in broke, and we were thrown completely forward and then completely bacwards. Upon impact, I hit the steering wheel even though I was wearing my seatbelt as was my son.
The driver of the truck does not have a license and was driving another individual's vehicle. Thankfully, the vehicle was insured. The driver was charged with having no driver's license and for failing to reduce speed to avoid a collision.
My son and I were transported by ambulance to the local ER where, after undergoing some tests, we were treated and released with the instructions to follow up with our doctor in 2-3 days.
My son seems to be doing better; he's still a bit sore and stiff, but I am having extreme pain in my lower back & legs, and on the left side of my neck, head, and my left shoulder as well as sharp pains shooting down my left arm.
I am very very aggravated right now as I cannot do the basic things a person can normally do. I am so sore, and have so much pain that I cannot even performing basic hygiene functions without assistance. I can't dress myself without assistance. I can't even stand to stand long enough to brush my teeth at the bathroom sink.
I cannot even attend a dear relative's funeral tomorrow afternoon because I can't stand to sit up for long periods and traveling any distance is painful so I am only doing that which is necessary (to doctor's appointments, etc.). I can't grocery shop, run errands to pay bills, and I certainly can't hold, much less babysit, my grandson which is what I did everyday. Now my son or his wife are having to remain home from work to care for him, and possibly find another caregiver. Honestly, this is what bothers me the most.
What is worse is I do not have personal health insurance, so my expenses are going to be "out of pocket", and my pockets are not deep at all in these tough economic times. My ER bills alone will eat through what little I have in the bank.
My questions are:
How do I go about getting compensated for my current and future medical bills?
Will I be reimbursed for the cost of my personal belongings that I cannot retrieve from my car due to the fact they are wedged in the trunk among the mass of tangled metal? I may, or may not, have receipts, but the items are still in the vehicle. There's just absolutely no way to free them.
Will the cost of things such as my son's eyeglasses that broke be reimbursed to me?
If I cannot afford to purchase his new eyeglasses (they're about 300.00 a pair), can I submit an estimate to the adjuster for a new pair?
Do I take my own pictures of the accident scene indicating the site of impact and where we ended up afterwards (these areas are marked by orange paint)?
Do I need pictures of my car, and if so, how many and of what exactly?
