If you wish to make a claim for compensation you can do so if your employer was to blame for the accident either because they were negligent or in breach of statutory rules such as health and safety regulations.  By Law, your employer must have insurance to cover liability for the accident. The insurance does not pay out automatically just because you have had an accident; you have to prove a case of negligence or breach of statutory duty to win your case. Once a letter of claim has been sent to the company by your lawyers, the insurers will take over the case and decide whether to pay you compensation. If they do not agree to pay, you can take the company to court, if you have a good case.
