Slipped on Wet Floor

Hi,

I slipped on a wet floor and hurt my back. There were 3 witnesses but I was so shaken and in a lot of pain at the time the last thing I thought about was getting witness details. I did however fill in the accident book. I never thought about making a claim at first but 2 weeks later I am still in a lot of pain with my back. I have seen the doctor several times already and I am still being treated for the pain. I am self employed so cannot claim sick pay it has already cost me because I cannot work as normal plus the on going problems with my back. Is this something I can claim for?

The floor was wet which the witnesses picked up on, I am not sure if it had been washed or was because there had been rain (although it was dry at the time of the accident) there was no sign. I had just been walking round the shop. The shoes I was wearing were shoes I always wore and shoes I regularly wear in the shop.

I am not trying to make money. If the back injury had cleared up within a couple of days I would not even have thought about making a claim but the fact it is now 2 weeks on, I am still in a  lot of pain and have lost financially I feel perhaps I should claim?

You would have to prove that the condition of the floor was slippery and this
caused you to fall. It is a pity that you did not get the witness details, but I
would still make a claim because you did report it and the accident book was
completed and you are still suffering 2 weeks later.  The company will have to
provide a copy of the accident book if you make a claim and this will help you prove
your case. If the floor was wet due to rain, that is harder to win. Large shops
should have means of wiping feet and train staff to watch out for the floor on rainy
days. Smaller shops would not be expected to do that. It was not a wet day though,
so probably someone had mopped the floor a few minutes before you went in the shop
and they forgot to put a sign out.

If there was an accident at road and it resulted in your personal injuries or recourses injury without your fault then according to the law you can opt for road accident , you should always get ahead to seek compensation. In your case also, fault is not your end, hence apply for road accident claim, you will get total compensation. Consult with the solicitor for complete procedure.

Fault is not at your end and you should contact a legal representative for help. Looks like your have a personal injury case and you should seek a personal injury attorney. Look for a lawyer that offers free consultation to see if you do have a case.
