loss of earnings

I'm almost a a year into a claim fro a whiplash injury, part of which I am claiming for a loss of earnings. At the time of the accident, I was on a nil hour contract, but there was enough work at my company that I was considered F/T. Due to the accident, I found it hard to maintain full time hours so I reduced my weekly hours from 40 to 30. I asked my line manager (who is also the exuctive director for the subsidiary company that I work for) to advise my solicitor of this and she happily did. For whatever reason my solicitor also contacted  the eejets at head office (whom i have never had any dealings with) to advise her of my loss of earnings, but they have now contradicted what my line manager has said and have to my solicitor that I have no claim for loss of earnings due to not having contracted hours and supposedly maintaining full time hours after the accident. My solicitor has now asked me to supply further documentation with my workings out if I disagree with what H.O. have said. Does anyone know if this true, because I was not contracted and did not receive sick pay or have any deductions I am not entitled to loss of earnings? How is this any different to a self-employed person? At the time of the aciddent I was healthy and fit... Thanks in advance.

Again a bit of a difficult one to respond to especially as you already have legal representation it would be wrong of me to provide separate legal advise. I suggest your best course of action is to speak to your solicitor and request a plain English explanation to alleviate your concerns.
