legal proceedings for hire costs

I had a car accident on 13th December 2010 the third party paided out for my injury they took a long time to pay out for my car which was a write off following the accident the thiird party person hit my from behind while i was stationary at traffic lights . while i was waiting for them to pay me for my car i had a courtsey car off my insurance company as we went through my insurance company for the claim at the time of the accident i was also pregnaent  i had this courstey car for about two months and in total the car cost Â?6,000 and now the thrid party insurance are refusing to pay for this as they say it is too much my insurance company are now taking them to court over this if it goes to hearing i will have to go to court dont feel this is my problem it is causing me a lot of stress and we have a new baby i dont want to have to go to court of the insurance behalf if i did go would could i get compensation for the inconvience .
