Fed up!

Where do I start .. Had accident almost 3 years ago contacted Accident Direct who put me in touch with a solicitor, I fell over a cardboard tube sticking out of a bin bag and fractured my ankle. Im sorry to say I have no faith in my solicitor due to the following.....
The only time I hear anything is when I ring him.
Then he asks questions that Ive told him the answers to before & written & sent him.
Said its tough as there was no witnesses which there was as her name was given to him when I first had contact with him.
Said if thats the case could I contact her... I dont know the lady as she was a supply teacher !
Now the company that my former employees have representing them have said Take this to court!
Im not greedy but I do feel these people owe me something as the fall also sped up an exsisting tumour I have in my foot, and face amputation in March 2012 .
Any advice will be great as I just feel at the moment the my solicitor just carnt be bothered.

Work injuries should be addressed in the proper manner.  Have you considered looking online?  You might be able to find an attorney that will represent you in the way that you see fit.  Obviously, the company feels that this will go no where, and that you will not push it. Have you consulted a Indianapolis injury attorney?

Thank you for ur response claimguy, no I havent contacted anyone else as I was under the impression that I just carnt up & leave and choose another solicitor...is that correct?

Yes you can up and leave to another solicitor.

In the event that you are unhappy with the way your current solicitor is handling your claim, you are perfectly entitled to go to another firm.

All that happens is that the new firm of your choosing writes to your old solicitor and asks for the case papers to be sent to them, and also provides an undertaking to pay the old firms reasonable costs at the conclusion of the case.

The only potential problem with your case is the time element.

Proceedings must be issued within 3 years from date of injury to safeguard your rights to claim.

Given that it can sometimes take up to 2 or three weeks for the old firm to receive the letter and then arrange for the file to be sent, and bearing in mind that they will be in no hurry as they are now losing your case, you need to ensure that your new solicitor is aware of the statute of limitation thereby ensuring your claim is not struck out because of the time issues.

If you are close to the 3 year time limit, you will need to move PDQ

Well my solictor has now said it looks like my employers seem to have to many witnesses for my case to be successful, as there was only me and one other person in the room when accident happened I dont understand what use all the other statements are .....but never mind, I just wish I hadnt wasted almost 3 years of my time and that National Accident had found me a solicitor who could have been bothered to hand out the help & advice I was lead to believe I would get.
