There is a legal obligation for anyone involved in a crash to -
Stop
Give the registration make of the vehicle
Provide the name and address of the drivers of the vehicle
Provide details of the owners of the vehicle (maybe a company vehicle for example)
And in the case of injury, provide details of the isnurance with any person who has reasonable grounds to so require those details.
If any of these elements are not complied with, then it must be reported in person to the Police as soon as practicable but in any case within 24 hours.
In this case, the driver of the other vehicle has clearly failed to comply with the law and committed the offence of failing to stop and report an accident.
Therefore, you have 2 options.
1. make a formal complaint of failing to stop and report to the Police. The Police will be required to interview the driver and obtain vehicle details which you are entitled to have.
2. Make a claim via the MIB through your insurance company. The MIB will investigate and will hod the third party liable if he/she fails to provide the appropriate information, but be aware that the MIB do have a Â?250 excess on the first part of each and every claim, and so it may also require you to issue proceedings to claim back your uninsured losses
3. The final option is to make a straight claim through the small claims court against the third party. The third party then becomes personally liable for all costs and so it would be in his/hr interest to provide the appropriate information to his insurance company.
