court action
I was involved in an RTA in Feb '09 third party driver was on the wrong side of the road and police sent case to procurator fiscal, i damaged my knee in the crash and was off work for 18 weeks. I have had physiotherapy and was on pain relief for nearly two years. The third party insurance company have been difficult from the start. Eventually the admitted liability. I now have papers lodged at the sheriff court but they have lodged a global offer with the court, which is far lower than the solicitor quoted in the papers (more than half). I really want to go to court but i am unsure of the risk. Does anybody know how often a sheriff would decide on a lower figure leaving me with legal fees to pay?
