Had my medical (to do with my rta injury) i have been diagnoised as having a whiplash injury.  The doctor has put it down as being a mild to moderately severe disablity, does this mean that the doctor sees my injury as just being mild? Coz it sure feels worse than that!! She says i need more physiotherapy and that the pain should resolve over 6 months (hopefully) Also have pain in my left hand and arm which the doctor put down the same diagnosis as the neck and shoulder pain. Also says my travel anxiety should resolve over the next 12 months and my travel discomfort should resolve over the next 6 months, that i am currently restricted at work, my ability to work is likely to improve steadily. How is the compensation calculated? Would the hand and arm pain be seperate to the neck and shoulder pain? Any ideas (not including loss of income) i should be asking for? Yes i have a paralegal but he wont tell me when i ask as i havent said if im going to settle now or later. Would help if i understood the medic report!!

Dear Luaive,

I don't know if you still require a response to the below however I can profer the following:

Once the medical report has been obtained it should be possible to either quantify the likley losses or assess the next step in your recovery. If you do not understand the medical report then your solicitor should be able and prepared to explain it to you.  I note that you have a paralegal representing you and whilst paralegals provide an invaluable role as a legal assistant to your claim they should not have overall conduct of your claim and it shoud be possible to speak to their supervising solicitor to address any questions that you may have.  Quantifying your claim is not a question of settling now or later and you should be looking to settle once you know whether the prognosis is likely to be met and you will not really know this until the prognosis period has passed.
