Claim Amounts

Hi all, wonder what your thoughts are.

I had an accident that was not my fault and the other party insurance accepted liability. I have reports done by specialists covering the three injurys in my claim. Having done much online research and using JSB Guidelines I worked out what a fair amount might be, in that I was certainly not pushing my luck with an amount I came to. I see little point in asking for a silly amount. My solicitors have suggested the claim is worked out as a whole rather than individual parts and why the offer received is a fair bit different than I worked out.

I personally dont think things should be worked out as a whole. If you go to court and they look at similar cases... surly all accidents differ and cant be compared as a whole. Im curious to see if there is a place I can go to and see what courts have agreed in payouts and how they came by those figures.

Can anyone help, thoughts please?

As has been explained before your claim is divided into two sections

General damages covers the actual injuries as well as pain and suffering, and each category will have a value according to whether it is minor, moderate or severe, although you only get one pain and suffering payment.

Then there are special damages which covers all you other costs such as loss of earning, out of pocket expenses, damaged property and so on.

No one here can give you a specific value as we do not know the details of your case, the type or severity of your injury or whether there is ikely to be any long term problems which can also affect the value of your claim.  This will only be determined once you have had the examination by the independent medical expert.

In the case of severe injuries, then something called the Ogden table will be used which over rules the JSB Guidelines, and so the only person who can give you a valuation is your solicitor who is privvy to your case notes and your medical records.

He should have already given you an estimate of what your claim is worth, no one here can thats for sure.

Hi not sure I explained myself properly. I understand what you mean about the two sections and general damages. I dont mean that.

What I mean is... Say in my accident I broke my arm, my leg and have whiplash. Say under JSB guidelines (amounts for illustration only) and with supporting evidence from specialists etc my injury's fall into a JSB category for minimum amounts of; Â?1000 for the whiplash, Â?500 for the broken leg and Â?500 for the broken arm that would equal Â?2000. I have been told that the insurance company and court will look at it as a whole not the three parts. And the court will also compare my accident to others and what the payouts were for the others so I would never get an offer of Â?2000. It would be more like say Â?1500. My solicitors are good and I have a good relationship with them. However having asked them twice they have given me the same answer.
