Making a claim

I was involved in an rta the other day sat in traffic and someone rear ended me, went down hospital an hour later because mty neck and shoulders felt like they were tightening up and got told i have a trapped nerve in my shoulder, i have to phone a physio helpline and get some exercises, i can only lift my arm so im standing like a T shape if i try and raise it higher i get tightening in my shoulder, my hands also feel tingly and numb and times (same side as injury) i have contacted my union as they have legal aid and they have given me the name of the solicitors that will be handling my case i said i have a trapped nerve (which is what i been told) i only want to make sure i dont end up paying for any treatment or the bill for being seen down the hospital, my question is seeing as it can take months/weeks to get anywhere then what happens if there is an improvement in the injury or a full recovery before any insurance doctors are seen would the case then be dismissed? Im not recovered yet as i said but i just wondered.

If you make a full recovery before you get to see the independent medical expert, then great, it does not affect your claim as the medical expert will have a copy of your medical and hospital records, and he/she will ask you certain questions which will help determine the severity of the original injury and whether there is likely to be any ongoing problems.

The third party insurers will be required to pay the hospital/medical costs and will form part of your claim.

No your case will not be dismissed.  You have still suffered and injury, there is still a payment for the actual injury, pain and suffering, loss of capacity and your out of pocket expenses.

Just don't expect the claim to be settled anytime soon.

All this should have been explained to you by your union appointed solicitors

Thanks i havent actually spoken to my solicitors i have a reference number and who they are but no phone call as yet, wondering if im supposed to call them :S

If your solicitor has been instructed by legal expenses insurers, they should contact you directly.

If not, then shop around for a personal injurysolicitor in your area, they will be able to fund your case on a no win no fee basis.

One word of advice though, do not go to any of the accident management firms such as those who keep touting for business on these boards, go for a local solicitor in your area.

There are many companies out there who would want to help but I came across one that helped me with my claim and gave me a Â?350 upfront bonus within 14 days of me placing a claim! I was well chuffed and I still got 100% compensation on a no win no fee basis so in total I received Â?2850 I would highly recommend these guys, with cash bonus you can't go wrong.

UPDATE

My paralegal called today said he had been given an offer from the insurers for 1,375 (have to admit that was much more than i expected) which was based on 3-4 months recovery time, asked how i was and told him honestly i have good days then i do something and im in pain the rest of the day, he said he would refuse this offer and make an appointment for a medical which could take a few weeks (im already going to physio) and get them to check and give an accesment as to when recovery would be which i accepted, im just a tad worried that my injuries might be good that day or be better and then the insurers will offer considerably less because of this.
