Undiagnosed Broken Back???!!!!

Hi, Lower back pain got worse earlier this year, couldn't stand the numbness & pins 7 needles any longer, went private, had MRI just been informed that the injury I suffered coming off my bike last year resulted in me breaking my back in two places. I was spinal boarded to a hospital at the time, but no xrays were taken, even when I asked my GP at a later date if I should have Xrays he said no point!!! Has anyone been through this, should I go through claiming for negligence from the hospital etc....I've suffered in silence, and just got on with it for the last year, no I know my moaning is justified but I'm angry.....

Can I assume that you are currently making a personal injury claim?

If you are, and if your solicitor also has a clinical negligence group, the it willl be worth speaking to him/her and get their advice.

The two are seperate issues, but to prove medical negligence it has to be shown that the actions of the Hospital staff were unreasonable, and if you had a suspected back or neck injury, I would argue that it would be reasonable to have carried out an X-Ray or MRI scan and the problem would have been spotted sooner.

If you make a medical negligence claim, it still does not preclude you from continuing with your Personal Injury claim, but you do need a medical negligence specialist, and many PI lawyers do not do clin neg.

How the hell can you say it is worth up to Â?15,000?  That is unprofessional and irrsponsible.  Until the full facts are known and the OP's personal circumstances are known you cannot put a value on the case.

It could be worth considerably more depending on the facts and severity, but to give a value without knowing the facts I would suggest leaves you open for a potential negligance case against you!!!!!!

That is providing of course you are a genuine legal professional

Hi.. I really agree with you Tony Carter. This is really very unprofessional comment to declare the compensation amount without knowing all the facts completely besides the negligence.
