my husband had a cycling accident last year where, according to the damage on his bike, he appears to have been knocked off it. But because he has no memory of what happened  and how he got home!  No witnesses were found and he has short term memory loss and is seeing a neurologist because of this, can a claim still be made?

Providing it can be established that your husband was actually involved in an accident, either as a result of being hit by another vehicle or a road defect, then yes, a claim can still be commenced.

The difficulty lies though in establishing liability, and tracing or finding the driver who may have been involved in the crash (have to assume that this would be deemed a non stop accident), or finding evidence to show that a road defect caused the problem.

This would be a very difficult case to run due to lack of evidence or a third party, and it may be that you could find someone (law firm) to run it as an MIB case under the untraced drivers scheme, but you would really need to sit down with a personal injury solicitor and run everythinng past him/her
