I was run over by a hit & run driver nearly three years ago. the driver was subsequently arrested & charged two weeks later, he was found guilty on all 3 charges & duly sentenced. He was insured. I suffered a multiple compound fracture to my tibia & fibula on my right leg. I was in hospital for a week whereby I had two operations including having an external fixator fitted and a skin graft. The fracture did not heal and the fixator was removed (another operation) and had to have a bone graft from my hip with an internal fixator fitted. This was removed about 18 months after the accident. I had to have five operations in total. The accident has left my right leg with severe scarring.
I am self employed and can prove losses in excess of £95k & I have had to employ somebody to carry out the physical work that I did before the accident. I also suffered a severe bout of PTSD. I have had several medical reports that state my leg is as good as it is going to get with no possibility of any major improvement. I can walk for about for about 500m unaided but after this I have to use a walking stick. I was 48 at the time of the accident.
I have before the event insurance and was pressured by my insurance company to use one of their panel solicitors. A protective claim has been made at court as the claim has now exceeded three years from the date of the accident.
The drivers insurance company paid me an interim of £10k last year. My barrister is pricing up the claim at the moment.
My questions are, how much longer can a claim like this go on for?
Can I claim for the wages of the person I have had to employ to carry out the physical elements of my work until the age of my retirement?
What is the likely value of my claim before losses are taken into account.
