Read my case and please give your opinion?!?!

Hi Guys,

Would like to get some answers on this to shed a light on the whole thing,

2 years ago i was ran over,me being a padestrian crossing the road. It was one of my ex friends that did it he drove into me at a slow speed of around 15 mphs (up hill) my mind going blank at the time,rather than facing the risk of going under the car and not knowing what would happen i was forced to lay upon his bonnet. At this point he gained speed and what my witnessed said was about 40 mph, i was screaming at him to stop. All this happened while going up hill so me being 15 stone at the time he would have needed to gain quite a lot of speed.

He then sharply put on his break causging him to skin a few feet and sending me flying about 5-6 meters if more? i was knocked unconcious and just remember friends crying and telling me not to move and something about blood draining down the road. When i re-gained consiousness i woke up in an ambulance with one of my friends that witnessed the whole thing i was layed on a spinal board with my head in a brace and my ankle in pieces, also a nasty gash to my head causing me to have stitches and a brain scan.

I was then in hospital for 10 days as the swelling would not go down, it would have been longer but i do not like hospitals at all. I then get told that i have 2 screws basically holding my ankle together and that i would not be able to ever do sports again which i enjoyed hugely. Rugby and football were my joy. My ankle looks deformed and my gf feels sick when she runs her fingers over the joint as it is well out of the ordinary.

I set the ball rolling for compo 5 month after the accident as all i was concentrating on was getting better. Ive been to the hospital about  6 times and also seen an independant private doctor to examin by ankle both for my solicitors and his insurance.

He got took to caught a year after my accident and with me having 3 witnesses he lost with just a fine but already had been banned for drink driving. He tried telling the court i was drunk and jumped out in front of him while he was going 10 mph. It doesnt take an idiot to think that 10 mph would give me the injuries i got. It is now 2 years later and due to me not being very mobile i have gained a massive 5 stone as all sports or excersive went out with the window (i have already been through the tears and upset). I was 19 when this happend and i am now 21, 22 this year, his insurance were not accepting liability but offered me first 50/50 liability ( which i turned down) they then came back and said they would offered 10 grand on a 50/50 basis for to shuttup and drop it, The way i see it is that 10 grand doesnt even scratch what i been through. They have just come back and accepted full liability , My dad studied law at uni and understands all about the ogden tables and courts. I Have just had my last examination with the pirvate doctor who assesed that now it has been 2 years he can safely say that the ankle is collapsing and that it would need fusing but only up until the point i would allow it, he tried moving my ankle and said there was not much movement,it is worse on hills and sloaps and at 21 is an embaresment for me, it also lockes up when driving and i have come close to crashing a couple of times because of this. The hospital have told me that what they did to my ankly was not made to support the weight i had put on and i had to lose 5 stone in 6 months or it would need fusing, the pirvate doctor says this is bollocks and wouldnt make a difference and that it would still be the same, obviously the weight isnt helping but it would still go down the path of being fused. i cannot even sit on the sofa with my legs down as it will start to ache. It effects all job oppertunites and at the moment i am unemployed and virtually have been since last year bills and rent fall behind but i recieve another interin payment bringing me up to date. I have had a £1500 interim and a £2000 intermin payment. The insurance have dragged this out for as long as they could and my solicitor actioned court proceedings and as soon as this had been done they admited full liability. I have been told they were trying it on because of my age and that i would bite to there poxy ten grand. This kid is driving again and still is causing terror on the streets ,he drives up my bank end really close and speeds to over take me, I hear you say to tell the police? they are no good, on the night it all happend the only person they asked what happend was the kid himself,they did not ask the other 3 witnesses that were there that night, the report this kid gave followed me to the hospital and was in my file and so i was treat like a stupid drunk kid pratting about which was not the case, they also took 6 months in writing the report and sending it to court.

This puts stress on my life i cant be very sociable or take my girl friend out shopping because i cannot be on my feet for a long time, i cannot walk about a little one bedroomed flat as it is stiff and aches, I have to ask my girl friend to do everything for me more like shes my carer and shes only 19, this is upsetting me as i type this. any labour job or job on my feet both the hospital ,the private doc and myself all know it is a big NO NO! I recently went to an interview for a call centre job and they asked me why i was limping ,i told them the reason, out of conversation the bloke interviewing me i told him that i may have to go back to hospital and have another operation, this was just in conversation i said this. He came back telling me i had passed and got the job however could not offer the most recent position as he wanted to know how much time i would be having off etc, i adv him i was not sure as i did not know if it was deffonate and that i had just been instructed to go back to the hospital in 6 month, he told me they werent prepared to set me on if i was planning on taking time off. So im skint, over weight, have no life, i have one hobby and that is drawing and plan to open my own tattoo studio with the compo i recieve.

The thing is like i said my dad studied law and as a child i remember there always being a book about law sat at the side of the toilet that my dad was reading when doing his buissnes Lol. he also went to Rotherham college to study the subject.
He says bassed on the ogdens tables i am looking for a figure anything from 30+, i say thirty he says a lot more, my solicitor says she cannot give me a figure as she is not allowed but all she is saying it is deffo 10 grand+ plus, this does not interest me in the slightest, i would rather take this matter to court.

Now ive been all the way round the internet trying to find some source that will tell me, ive seen all this comp calculators that give you a rough estimated figure, now for a severe ankle injury where bolts and plates have been needs it says it can be £18,000 anything up to £30,000 but does not go into depth about permanemt disability as i have the rest of my life to go through. My dad says these figures are for a break thats had plates and everythings fine after, my older brother broke his ankle playing football but not so bad and had a plate but is fine and can do sports, i have broken something called a Talus or something not sure what it was but i smashed the joint completely. My dad says the figure of £30,000 is for the damages to my head and ankle,the loss of earning in the 6 month i took off work when i had the accident and all other cost we claimed around a year ago which basically covers the intermin payment, after the £30,000 they then have to compensate me for the rest of my life which my dad reckons is the next fourty years working out to be between £500 to a £1000 per year and rather than they give me this per year would rather pay me off and leave it which is an extra £30,000 - £40,000 on the existing £30,000. I will fight this and no way on this earth i would accept less than £30,000 i would rather go to court to fight and face losing it all but i have also been told that the insurance will not want to go to court because of all the time wasting done by them,thats the reason why when court proceedings have been actioned they come back with 100% liability can anyone reflect to this or at least give me more information or what they think all the matter??
