Counter claim against collision with bollard on private property?

Hi,

I was recently in a car accident: I was entering a business park and as I was going around a bend in the road, my car wheel hit the kerb and the car mounted onto the pavement and hit the metal bollard positioned on the pavement. As it was private property, I was soon informed by the site manager that my insurance would need to pay for damages made to the bollard and the pavement.

I wanted to find out if I was able to make a counter-claim against the site owners due to damage caused to my car by the bollard. As it is private property, is the owners required to have planning permission etc. to have the bollard in place?

You could, but it would not succeed.  As it was your fault that you mounted the pavement all consequences of your actions are your responsibility as the owners of the property have not breached any duty of care.
