tripped over raised drain fractured elbow,radius,scaphoid,ligament dam

It all depends on what injuries you have and any evidence. Did you take a picture of the drain or is it still in the way it was when you tripped up ?

Make sure you get as much evidence as possible to build a really strong case. Take photo's to court if need be to show the danger of the drain.
