Crunched elbow and fracture of the arm

The accident took place due to the fact that big, metal element slided down from about 4 m. It caused the separation of another element, which fallen down on my elbow. The weather was terrible that da â?? it was windy and it was raining and I think that it was the main reason why the accident occured. I had an operation on my elbow  on 24.06.2009.  The surgeons put 5 screws and plate on my bones of the right arm.

In fact, as I mentioned before, it was due to the weather that I became injured. I don't know how to proof that thre should be taken some precautions against sliding that metal element. Do I still have some chance to get money? I don't want to become rich but I need another operation and I am afraid that I won't be able to come back to work soon.
