Toddler Injured Falling in Church
I attended a Christening Service at a local church on Sunday 26 April where my 22 month old son sufferred an injury when falling in an area at the rear of the church that is set aside for children.
I believe the church were negligent in that although the fall was just due to the clumsiness of my son, what he fell onto was clealrly not at all child-safe. We were sat on a row of 4 chairs, which were hooked together by a brass bolt-like mechanism attached to the outer side of each front chair leg. Unfortunately the end chair in the row, which broke my sons fall, was identical to the others and (with it being the end chair in the row) the brass-bolt was exposed; sticking out sideways. My son fell onto the object, impaling him by the left nostril, causing a deep laceration to the inner wall of his nose, profuse bleeding and tremendous upset. This resulted in a visit to A&E where we were told to return in a few days time once the swelling had reduced in order that further consideration could be given to treating the wound. They warned that he may require plastic surgery to fuse the wound together.
Clearly there is an ethical issue about making a claim againsts the church, but the more I've thought about it the more I am incensed that nobody at the church had the foresight to see that in an area designated for children it was not a sound decision to leave a sharp circular object exposed in the way that it was. I also can't get it out of my mind that an inch higher and he could easily have pierced his eye, which would have been an altogether more serious incident.
Does anyone think I should pursue this further through a legal claim, or is it best that I air my views to the church directly and suggest they remove the hazardous exposed object immediately?
