fall from a wrong assembled rack at work

The injured friend has accident during his work. He fell from a rack. It was wrong assembled by his superior. Ithe rack didn't have screws in order to secure. In result he broke a little toe. He underwent a surgery and a cycle rehabiliation. My friend didn't want to work  with this rack. He had the employment contract for an unspecified/indefinite period of time but the employment dissmised him, lack of sickness benefits. The accident happend in August 2008.
